The Formal Physical Evaluation Board (PEB) is a non-prosecutorial fact finding board. It affords the opportunity for the Service member to appear in person, be represented by counsel, and provide sworn testimony in support of their case. Formal PEBs are a “de novo” proceeding; once a Formal PEB is convened, previously issued findings are nullified and no longer available for acceptance.
Communication with the Board
Once Service members demand or are approved for a Formal PEB, the PEB generates and issues a scheduling letter with the date of appearance. The scheduling letter is served via the Service member’s PEB Liaison Officer (PEBLO) or through certified correspondence.
The PEB provides instruction and facilitates Service member travel to the Washington Navy Yard in support of the formal hearing. This includes information for Defense Travel System (DTS) for active duty personnel. It is incumbent on the Service member to keep their command informed of the status of their Formal PEB and leverage their expertise as it applies to DTS. Reference the travel instructions below.
Service members may provide additional information for consideration. Information must come through detailed counsel, who will be appointed by the Office of the Judge Advocate General. Special requests such as: request to reschedule, request to have an escort, or any other specific needs should be submitted as soon as possible prior to the scheduled hearing date via detailed counsel or PEBLO.
